What to Bring to our Office

The following is a list of items you will need when opening an estate at the Surrogate's Court.

Please remember to check the death certificate to make sure the decedent was a resident of Gloucester County.The estate must be opened in the County where the decedent resided.

Please be advised that short certificates will not be issued immediately.

If there is a Will

The Executor will need the following:

  1. Certified copy of the death certificate 
  2. Original Will
  3. Original codicil (if relevant)
  4. Names and addresses of all immediate next of kin
  5. Addresses of all beneficiaries named in the Will
  6. Addresses of Witnesses to Will (if relevant)
  7. List all the assets in the decedent’s name to determine the number of short certificates needed
  8. If the first named Executor has predeceased the Testator, a copy of the death certificate
  9. Executor must provide a form of identification (such as a drivers license)
  10. Check, Cash or Credit Card
  11. The probate of a Will can not occur until the eleventh day from the date of death.  The process can be started before the eleventh day but the estate will not be issued until the appropriate day.

If there is not a Will

The person seeking to qualify will need the following:  (The Surrogate will appoint the appropriate person following rules of intestacy)

  1. Certified copy of the death certificate 
  2. Names and addresses of all immediate next of kin
  3. Renunications from all adult persons whose right to act is prior or equal to that of the applicant
  4. List all the assets and their values in the decedent’s name alone to determine the number of short certificates/affidavits needed and to determine if a bond will be required.
  5. Administrator/Affiant must provide a form of identification (such as a drivers license)
  6. Check, Cash or Credit Card
  7. An Administration can not occur until the sixth day from the date of death.  The process can be started before the sixth day but the estate will not be issued until the appropriate day.
